The terms "we", "us" and "our" refer to Veloreah, a brand operated by Case Sensitive Computers, LLC. Veloreah operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Veloreah is powered by Shopify, which enables us to provide the Services to you.
These terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

To use the Services, including accessing or browsing our online store or purchasing any products or services we offer, you may be asked to provide certain information, such as your email address, billing information, payment information and shipping information.
You represent and warrant that all information you provide is accurate, current and complete and that you have the right to provide such information.
You are responsible for maintaining the security of your account credentials and for activity conducted through your account. You may not transfer, sell, assign or license your account to another person.
SECTION 2 - OUR PRODUCTS
We make reasonable efforts to accurately display and describe our products.
However, colors, print appearance, sizing, positioning, proportions and other visual characteristics may appear differently depending on your device, display settings, manufacturing tolerances, garment size or the printing process.
Many Veloreah apparel products are made to order or produced using print-on-demand fulfillment. Minor variations that are customary to garment manufacturing or printing may occur.
Product photographs, illustrations, digital mockups and other images are provided to represent the product as accurately as reasonably possible but are not a guarantee that every manufactured item will be visually identical in every respect.
Nothing in this section limits any warranty, remedy or consumer right that cannot lawfully be excluded.
All product descriptions are subject to change without notice. We reserve the right to discontinue products or limit product quantities, geographic availability or sales where permitted by law.
SECTION 3 - ORDERS
When you submit an order, you are making an offer to purchase.
Veloreah may accept or decline an order, subject to applicable law. An order is not considered accepted until payment has been successfully processed and we have confirmed the order.
Please review your order carefully before submitting it, including product, size, print placement, quantity, shipping address and shipping method.
Because many of our products are made to order, production may begin shortly after an order is accepted. Cancellation or modification requests therefore cannot be guaranteed after production begins.
If we cannot fulfill your order, we will notify you using the contact information associated with the order and provide any refund required by applicable law.

Nothing in this section limits a customer's statutory rights relating to delayed, defective, damaged, incorrect or undelivered merchandise.
You represent that purchases are for lawful personal, household, gift or other permitted use and not for unauthorized commercial resale or export.
SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions may change without notice.
The price charged will be the price displayed when your order is submitted, subject to correction of obvious errors and applicable law.
Unless expressly stated otherwise, displayed product prices do not include applicable sales tax, duties, customs charges or other government-imposed charges.
Shipping charges, if applicable, will be disclosed before checkout is completed.
Promotions may be subject to separate terms. If promotion-specific terms conflict with these Terms, the promotion-specific terms will control for that promotion.
You agree to provide accurate and current billing, account and payment information.
You represent that you are authorized to use the payment method submitted with your order.
SECTION 5 - SHIPPING AND DELIVERY

We will use commercially reasonable efforts to process and ship orders within the timeframe represented to you at the time of purchase.
Delivery dates may be affected by carrier operations, weather, customs processing, natural disasters, address problems, supply interruptions or other circumstances outside our reasonable control.
Nothing in these Terms eliminates any rights you have under applicable law when an order cannot be shipped within the promised timeframe.
If we cannot ship an order within the timeframe promised to you, we will provide any notice, cancellation opportunity, consent request or refund required by applicable law.
Risk of loss will transfer in accordance with applicable law. Nothing in these Terms is intended to make a customer responsible for merchandise that was never properly delivered to them.
SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including trademarks, branding, text, graphics, photographs, product designs, artwork, videos, audio and the selection and arrangement thereof, are owned by Veloreah, Case Sensitive Computers, LLC, their affiliates or licensors, as applicable, and are protected by applicable intellectual property laws.
These Terms permit you to use the Services for personal, non-commercial purposes only.
Except where permitted by law or expressly authorized by us, you may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, commercially exploit or transmit protected material from the Services without permission.
Nothing in these Terms transfers ownership of Veloreah intellectual property to you.
Veloreah names, logos, product names, designs, graphics and slogans may constitute trademarks or other protected intellectual property.
Shopify's trademarks and intellectual property remain the property of Shopify or its licensors.

You may be provided access to tools or functionality supplied by third parties.
Unless otherwise stated, we do not control such third-party tools.
Third-party tools may be subject to their own terms, privacy practices, warranties, limitations and policies. Your use of them is subject to those terms.
To the extent permitted by law, we are not responsible for loss caused solely by a third-party service over which we have no reasonable control.
New features, tools or resources added to the Services may also be governed by these Terms.

The Services may contain links or functionality provided by third parties.
We are not responsible for the accuracy, content, availability, privacy practices or business practices of third-party websites or services that we do not control.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
Veloreah is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Veloreah.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Veloreah, including any injury, damage or loss resulting from purchased products and services.
You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Veloreah.

If you voluntarily submit ideas, suggestions, reviews, feedback, proposals, photographs, comments or other content ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute and adapt that Feedback for legitimate business purposes, including operating, improving and promoting Veloreah.
You represent that you have the necessary rights to submit such Feedback.
You agree not to submit unlawful, defamatory, infringing, deceptive, threatening, malicious or otherwise prohibited material.
You remain responsible for the accuracy and legality of Feedback you submit.
Nothing in this provision authorizes us to misrepresent your Feedback or use endorsements or reviews in a manner prohibited by applicable law.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally, information on the Services may contain typographical errors, inaccuracies or omissions involving product descriptions, pricing, promotions, shipping charges, shipping estimates, availability or other information.
We may correct genuine errors or update information as permitted by law.
If an error materially affects an order you have already submitted, we will notify you where required and provide any cancellation or refund rights required by applicable law.

Termination does not eliminate payment obligations, rights, claims, liabilities or provisions that arose before termination.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SERVICES PROVIDED THROUGH THE WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE."
WE DO NOT WARRANT THAT WEBSITE ACCESS WILL ALWAYS BE UNINTERRUPTED, ERROR-FREE OR COMPLETELY SECURE.
ANY IMPLIED WARRANTIES THAT MAY LAWFULLY BE DISCLAIMED ARE DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VELOREAH, CASE SENSITIVE COMPUTERS, LLC, AND THEIR AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, SERVICE PROVIDERS AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SERVICES.
THIS LIMITATION DOES NOT APPLY WHERE LIABILITY CANNOT LAWFULLY BE DISCLAIMED OR LIMITED.
NOTHING IN THESE TERMS LIMITS LIABILITY FOR FRAUD, WILLFUL MISCONDUCT OR ANY OTHER LIABILITY THAT APPLICABLE LAW PROHIBITS US FROM LIMITING.

To the extent permitted by law, you agree to indemnify and hold harmless Veloreah, Case Sensitive Computers, LLC, Shopify and their respective affiliates, officers, employees, contractors, agents, licensors and service providers from third-party claims arising from:

2. Your unlawful use of the Services; or
3. Your infringement of a third party's rights.
This obligation applies only to the extent permitted under applicable law.

If any provision of these Terms is found unlawful, invalid or unenforceable, the affected provision will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will continue in effect.

Failure to enforce a provision of these Terms does not waive our right to enforce that provision later.
These Terms, together with policies incorporated by reference and other terms presented at checkout, constitute the agreement governing your use of the Services and purchases from Veloreah.

You may not transfer or assign your obligations under these Terms without our written consent where consent is legally required.
We may assign or transfer our rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, transfer of the Veloreah business or similar transaction, subject to applicable law.

These Terms and transactions with Veloreah are governed by the laws of the State of Michigan and applicable federal law, without regard to Michigan's conflict-of-law rules.
To the extent legally permitted, disputes relating to these Terms or the Services will be brought in an appropriate state or federal court located in Michigan.
Nothing in this section deprives a consumer of mandatory protections, jurisdictional rights, small-claims remedies or other rights that cannot lawfully be waived under applicable law.

Continued use of the Services after updated Terms become effective constitutes acceptance to the extent permitted by law.
